Sometimes the complaints resulted in corrective action sometimes they didn’t. Bortz kept calling Andrew Klooster, Earthworks’ Colorado field advocate, who kept driving from Denver to document the emissions and file complaints with state or county regulators. The process has felt, to Bortz, like a twisted game of whack-a-mole: Despite several repairs by Prospect, the leaks kept returning. Relief has come slow for Bortz, who for 11 months has raised concerns about how troublesome smells and emissions from the tanks have sickened him and driven him inside. In the meantime, Prospect Energy has completed another round of patching on the tanks "that appears to be working and should hold us until the new tanks are installed and functioning," owner Ward Giltner told the Coloradoan in an email. He declined to share exactly when the new tanks will be installed. The new tanks should arrive at the site the week of Dec. Two of the produced water tanks are expected to be replaced in mid- to late December, according to the state.

The tanks have been sporadically leaking an unknown quantity of air pollutants for more than two years. They’ve lived next to the sanctuary for close to five years, about 1,000 feet south of Prospect Energy’s Krause tank battery site - a storage facility for crude oil and produced water from the company’s nearby oil wells.
